Washout Settlements
Many workers’ compensation cases reach a point
where a washout settlement is in the best interest
of the injured worker. This results in a full and
final settlement of the case regardless of whether
legal issues are pending at the time of settlement
or not. The evaluation for settlement varies for
each case and depends in part upon the exposure of
the case and the litigation which was involved. The
settlement of a case is a formal process which
requires the execution of extensive documentation.
These documents are prepared by attorneys for the
insurance company. Often, specific terms need to be
incorporated into the settlement documents to
protect the injured worker or enforce a resolution
of issues. Just as importantly, there are many
instances where certain terms need to be stricken or
modified in the settlement documents to avoid the
injured worker from being compromised.
