WORKERS’ COMPENSATION LITIGATION
REPRESENTATION OF INJURED WORKERS

Mediation
After a Petition for Benefits is filed, the Judge
of Compensation Claims issues an Order requiring the
parties to attend mediation. This is a necessary
process, and a case cannot proceed to trial unless a
mediation has occurred in good faith. The mediation
is a more informal means for resolution of disputes.
In fact, often times the parties agree to attend
mediation on a voluntary basis. The process of
mediation is one of the most valuable tools in the
workers’ compensation system. It can be used to
address a resolution of issues or a lump sum
settlement. The mediator is an unbiased third party
who is often an attorney. Mediators do not make
rulings and instead serve as professional
negotiators between the parties. It is not uncommon
for there to be multiple mediations during the life
of a case.
Mr. Fee and Mr. Chait are well versed in the
mediation process. They approach each mediation with
the utmost preparation and professionalism so that
their clients have the best possible opportunity to
benefit from the mediation process. This type of
focus requires the accumulation and organization of
evidence as well as the outline of legal arguments
to support each case. Their clients are a valuable
component to a successful mediation.
