Entitlement to Indemnity Benefits

 

Injured workers may be eligible for the payment of indemnity benefits if their work related injuries prevent them from returning to work in a light duty or full duty capacity. A claim for indemnity benefits must be supported by a documented disability status from the authorized treating physician. Injured workers should maintain copies of each "notice of disability" or "work status form" to support their entitlement to benefits. It is also recommended that they retain copies of their workers’ compensation check stubs in date order. Entitlement to indemnity benefits is multi-faceted and could include the payment of temporary total disability, temporary partial disability, impairment income benefits or permanent total disability. If the payment of benefits is delayed or denied, the filing of a Petition for Benefits may become necessary. In such instances, the injured worker will need to provide his or her attorney with documentation in support of disability. The workers’ compensation law contains many defenses which can result in the suspension of indemnity benefits or the non-payment of indemnity benefits in their entirety.
