Petition for Benefits
A Petition for Benefits is filed in order to
formally pursue an injured worker’s claim. However,
this vehicle can only seek benefits that are in
default and which are ripe, due and owing. The law
requires that each Petition for Benefits meets
specificity requirements, or it can be dismissed. In
many instances, evidence to support the claims being
made must be attached to the petition. There are
also certain filing requirements in order for a
petition to be valid. Each Petition for Benefits is
referred to the Judge of Compensation Claims
assigned to your case. The litigation process ensues
from there. Often times, the filing of multiple
Petitions for Benefits is required during the life
of the case.
