Attorney’s Fees
Mr. Fee and Mr. Chait represent injured workers
on a contingency fee basis. A Retainer Agreement
must be executed on each case which provides the
attorney with authorization for representation.
Injured workers do not have to pay an up front
retainer fee in order for the attorney to be
retained. Attorney’s fees can be paid by the client,
the insurance company or a combination of the two.
Certain scenarios can result in the payment of
multiple attorney’s fees during the life of a case.
If a client is responsible for the payment of
attorney’s fees, such payment will either come from
benefits secured by the attorney or from a
settlement which is negotiated by the attorney. The
amount of the attorney’s fee can be based upon a
statutory fee schedule or an hourly fee basis
depending upon the circumstances of each case and
the litigation involved.
In most circumstances, clients are made aware of
the payment of attorney’s fees and are often
required to execute documentation which confirms the
agreement between the parties to make such payment.
Prior to the payment of an attorney’s fee,
supporting documentation outlining the agreement and
substantiating the payment of same must be submitted
to the Judge of Compensation Claims for review and
entry of an Order.
