WORKERS’ COMPENSATION IMMUNITY

Workers’ compensation is the injured employee’s exclusive remedy for on the job injuries in most instances. However, there are several exceptions to the law.

Denial of a workers’ compensation claim by your insurance carrier can result in a civil lawsuit for damages because the employer may no longer enjoy the defense of workers’ compensation immunity. In such situations, a conflict of interest may exist between your business and your workers’ compensation insurance carrier. We would recommend in those instances that you request your insurance carrier to provide your business with separate legal counsel in those instances which warrant such action.
