In an effort to clamp down on the use of independent
contractor status to avoid the payment of workers’
compensation premiums, the Florida legislature has
created a very specific set of criteria which must be
met. As a result, many service providers, who hold
themselves out to be independent contractors, do not
meet this criteria.
Utilizing service providers who do not meet the legal
criteria to be deemed an independent contractor can
create exposure for workers’ compensation premiums on
the amounts paid to the service provider. Furthermore,
your company’s workers’ compensation carrier can be
forced to pay the claim of the service providers’
injured worker.
