WORKERS’ COMPENSATION LITIGATION

REPRESENTATION OF INJURED WORKERS

Petition for Benefits

A Petition for Benefits is filed in order to formally pursue an injured worker’s claim. However, this vehicle can only seek benefits that are in default and which are ripe, due and owing. The law requires that each Petition for Benefits meets specificity requirements, or it can be dismissed. In many instances, evidence to support the claims being made must be attached to the petition. There are also certain filing requirements in order for a petition to be valid. Each Petition for Benefits is referred to the Judge of Compensation Claims assigned to your case. The litigation process ensues from there. Often times, the filing of multiple Petitions for Benefits is required during the life of the case.

Mr. Fee and Mr. Chait assist their clients in determining when a Petition for Benefits is required, and they are well versed in pleading the nature of each claim. Furthermore, they will work with their clients to ensure that the proper evidence is secured and attached to the petition to minimize the risk of dismissal.
